Terms of Service

These Terms of Service ("Terms") govern your access to and use of software products operated by Ketabian LLC, a Delaware limited liability company ("Ketabian", "we", "our"), including SpeakFluently, Sentipus, Fifths, and Best Brooklyn (each, a "Product"). By creating an account or using a Product, you agree to these Terms.

1. Eligibility & account

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use a Product. You are responsible for keeping your account credentials secure and for all activity under your account.

2. Acceptable use

You agree not to:

• Use a Product to violate any law or third-party right.
• Reverse-engineer, scrape, or attempt to extract source code, except as expressly permitted by law.
• Interfere with the integrity or performance of a Product.
• Submit content that is illegal, harassing, or infringing.
• Use automated systems to abuse rate limits or generate fraudulent activity.

3. Subscriptions, sessions & billing

Some Products offer paid sessions, subscriptions, or one-time purchases. Prices are shown in the Product before purchase and may change with notice. Payments are processed by Stripe and, for in-app purchases on iOS or Android, by Apple and Google respectively under their store terms.

Refunds for in-app purchases are handled by the relevant store. Refunds for direct purchases on our website are at our discretion; contact billing@ketabian.com.

4. Your content

You retain ownership of content you submit to a Product (text, audio, etc.). You grant Ketabian a worldwide, royalty-free license to host, process, and display that content solely to operate and improve the Product. We do not use your content to train third-party AI models.

5. AI & generated output

Some Products use third-party AI models (including OpenAI's). Generated output may be inaccurate, biased, or unsafe. You are responsible for evaluating output before relying on it. Do not use Products for high-stakes decisions (medical, legal, financial) without independent verification.

6. Intellectual property

Ketabian and its licensors own all rights in the Products, the websites, and our trademarks. These Terms do not transfer any of those rights to you except the limited license to use the Product as intended.

7. Termination

You may stop using a Product at any time. We may suspend or terminate your access if you breach these Terms or if we are required to by law. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, dispute resolution) will survive.

8. Disclaimers

The Products are provided "as is" and "as available". To the maximum extent permitted by law, Ketabian disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Ketabian's aggregate liability for any claim arising out of or relating to the Products will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$50. Ketabian will not be liable for indirect, incidental, special, or consequential damages.

10. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you and Ketabian consent to personal jurisdiction there.

11. Apple App Store EULA

If you obtain a Product through the Apple App Store, the Apple-licensed application end user license agreement also applies, with these additional terms: (a) these Terms are between you and Ketabian only, not with Apple; (b) Apple is not responsible for the Product or any claims relating to it; (c) Apple is a third-party beneficiary entitled to enforce these Terms against you.

12. Changes

We may update these Terms from time to time. Material changes will be announced in-product or by email at least 14 days before they take effect. Continued use after a change means you accept the updated Terms.
